Thank you so much for the follow-up information. Based on your feedback, we contacted our experts in active adult living and learned that HUD requires age restricted communities to conduct an age survey every two years.
Ultimately, the Board is required to comply with the HUD requirement but may not be aware if the governing documents do not specify this requirement. Documents written recently will include a reference to this requirement and give the board the authority to request information about the homes’ occupants ( not owners) for compliance. In fact, some communities include in the governing documents that all residents (buyers, occupants, co-occupants, and/or lessees) as well as permitted health care residents must be approved by the respective board of directors in order to reside in the community.
