I live in an upscale HOA community. I have lived next to a neighbor who’s “crazy” and mean. My husband, myself and neighbors rarely speak to him. Our common fence was hit with termites last yard and I asked him if he would be willing to share the costs to replace. He stated, “no, and I better not put up another fence without his approval.”
The fence is ridden with termites and is unsightly. Seeing that he won’t help pay for it, I am willing to put up a 6 ft wooden fence on my own property right next to the old one. Am I responsible for painting his side of the fence and can he sue me for any reason?
